Terms and Conditions

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Learn and Earn 2023 Giveaway (“Giveaway”) is open only to United States educators in a public, private, virtual, or charter school setting; individuals who are 18 years or older as of the date of entry; and legal residents of the Fifty (50) United States. The Giveaway is void where prohibited by law. Employees of Seesaw Learning, Inc. (“Sponsor”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Only one entry allowed per educator.

2. Agreement to Rules: By participating, the entrant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Sponsor as final and binding as it relates to the content of this Giveaway.

3. Entry Period: Entries will be accepted online starting on November 27, 2023 at 10am EDT and ending on January 31, 2024 at 3:30pm EDT (“Entry Period”) or while supplies last, whichever occurs first. Entries submitted after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for this Giveaway.

4. How to Enter: The Giveaway has nine activities that you can complete during the Entry Period (“Giveaway Activity” or “Giveaway Activities”). You can participate in all or some of the Giveaway Activities during the Entry Period. However, to qualify and earn credit for Seesaw gear, you must complete a minimum of three (3) Giveaway Activities. You must fulfill all of the requirements for each Giveaway Activity, as specified, for that Giveaway Activity to be counted as complete. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You must provide the information requested. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Sponsor.
During the Entry Period, You earn credit towards Seesaw gear based on how You decide to participate. Credit earned can be redeemed for Seesaw gear at the URL which will be provided when You receive your credits.

5. Potential Winner Notification: Each potential winner will be notified within three (3) business days of submitting the Google form. Credits will be awarded based on completing the Giveaway Activities and providing accurate responses to the questions within the Google form. Credits must be used within sixty (60) days of being awarded. Sponsor shall have no liability for winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If You cannot be contacted, are ineligible, or fail to redeem the credits within sixty (60) days from the time award notification was sent, the prize may be forfeited. Receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

6. Prizes: Prizes differ based on the number of Giveaway Activities you participate in. For completing three (3) Giveaway Activities You will be awarded $15 credit toward Seesaw Gear; for completing six (6) Giveaway Activities You will be awarded $35 credit toward Seesaw Gear; and for completing all nine (9) Giveaway Activities You will be awarded $75 credit toward Seesaw Gear. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. Credits and prizes are nontransferable. Limit one entry per winner per Giveaway Activity. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner.

7. Compliance with Code of Conduct: By participating in the Giveaway, You certify that You are in compliance with the code of conduct of your employer; and that any prizes you receive as a result of your participation in the Giveaway do not violate the gifts and hospitality rules, or similar rules of conduct, of your employer.

8. Rights Granted by You: By entering this Giveaway, You understand and agree that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, social media username, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms and Conditions. Sponsor has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability: By entering, You agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error in the administration of the Giveaway or the processing of entries.

11. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). You further waive all rights to have damages multiplied or increased.

Requests must be received no later than March 1,, 2024 unless otherwise required by applicable law.

3. How to Enter: In order to participate You must be invited to the “Harness the Full Potential of Seesaw” by Sponsor and attend the webinar. By completing these steps You will automatically receive one entry into the Sweepstakes. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You must provide the information requested. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Sponsor.

4. Drawing: Following the webinar, Sponsor will select one winner in a random drawing from among all entries.

5. Potential Winner Notification: The potential winner will be notified via email following the webinar at the email address used to register. Sponsor shall have no liability for winner’s failure to receive notices or for winner’s provision of incorrect or otherwise non-functioning contact information. If winner cannot be contacted, is ineligible, or fails to claim the prize via email following the webinar, the prize may be forfeited and an alternate winner selected. Receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

6. Prizes: The winner will receive catered lunch for teachers in their school worth up to $1500. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Sponsor. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner.

By completing these steps during the Entry Period, You will automatically receive one entry into the Sweepstakes. Each week that You participate, You will receive one entry. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You must provide the information requested. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Sponsor.

5. Drawing: Starting on April 3, 2023, Sponsor will select fifteen (15) winners per week for six (6) weeks in random drawings from among all entries received leading up to the drawing date. If necessary, the drawings will be repeated until fifteen (15) unique entrants have been selected. Winners can only win one prize per week, but are eligible to win each week that they participate in the Sweepstakes. Sponsor will attempt to notify the potential winner(s) within ten (10) business days of the drawing.
